These Terms & Conditions ("Terms") govern your purchase of Point.Piste products, your use of the Point.Piste website ("Website"), and your use of the Point.Piste mobile application ("App"). By accessing our Website, using the App, or placing an order for our products, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. About Point.Piste

Point.Piste develops sports technology products designed to simplify scorekeeping and improve the experience of players, coaches, referees, sports clubs, and recreational athletes.

2. Definitions

For the purposes of these Terms:

• "App" means the official Point.Piste mobile application available for supported mobile devices.

• "Website" means any official Point.Piste website or online store.

• "Products" means physical products sold by Point.Piste, including accessories and related equipment.

• "Services" means the Website, App, subscriptions, firmware, software updates, and related digital services.

• "Customer", "User", "You", or "Your" means any individual or legal entity using our Services or purchasing our Products.

• "Subscription" means any paid recurring service offered within the App.
   

3. Eligibility

By using our Services or placing an order, you confirm that:

• you are at least 18 years old, or you have permission from a parent or legal guardian;

• the information you provide is accurate and complete;

• you are legally capable of entering into a binding agreement under applicable law.
   

4. Orders

Submitting an order does not automatically create a binding sales contract.

All orders are subject to acceptance, product availability, and successful payment.

We reserve the right to refuse or cancel any order, including but not limited to cases involving:

• pricing or typographical errors;

• suspected fraud or unauthorized payment;

• product unavailability;

• incorrect or incomplete customer information;

• violations of these Terms.

If an order is cancelled after payment has been received, the payment will be refunded using the original payment method where possible.
 

5. Prices and Payment

Unless otherwise stated, all prices displayed on our Website are shown in Euros (EUR).

Applicable taxes are included where required by law.

Shipping charges, customs duties, and other applicable fees are calculated separately during checkout unless otherwise indicated.

Payment must be successfully completed before Products are dispatched.

We accept the payment methods displayed during checkout.

We reserve the right to modify prices at any time. Price changes do not affect orders that have already been accepted.
 

6. Shipping

Orders are normally processed within 1–3 business days.

Estimated delivery times are provided for informational purposes only and are not guaranteed.

Delivery times may vary depending on destination, customs procedures, courier services, holidays, weather conditions, or other circumstances beyond our reasonable control.

Customers outside the European Union are responsible for any applicable customs duties, import taxes, brokerage fees, or similar charges imposed by local authorities.

Risk of loss or damage to the Products passes to the Customer upon delivery, subject to mandatory consumer protection laws.

Ownership of the Products remains with Point.Piste until full payment has been received.
 

7. Product Information

We make every reasonable effort to ensure that product descriptions, specifications, photographs, compatibility information, pricing, and other content published on the Website are accurate.

However, minor differences in appearance, colour, packaging, dimensions, or technical specifications may occur without affecting the intended functionality of the Product.

We reserve the right to improve, modify, discontinue, or replace Products and specifications without prior notice where reasonably necessary.

Images shown on the Website are for illustrative purposes only.
 

8. Mobile Application and Software License

The Point.Piste App is licensed, not sold.

Subject to these Terms, Point.Piste grants you a limited, non-exclusive, non-transferable, revocable license to install and use the App solely for your personal or internal organizational use together with compatible Point.Piste Products.

You may not:

• copy, modify, or create derivative works of the App;

• reverse engineer, decompile, or attempt to extract the source code except where expressly permitted by applicable law;

• distribute, sublicense, rent, lease, or commercially exploit the App;

• use the App for unlawful or unauthorized purposes.

We may release software updates, security patches, firmware updates, bug fixes, or feature improvements from time to time. Some features may require installation of the latest version of the App.

Compatibility may vary depending on your mobile device, operating system version, Bluetooth hardware, and third-party software beyond our control.
 

9. Subscription Services

Certain App features require an active paid Subscription.

Available subscription plans may include:

• Monthly

• Quarterly

• Yearly

The exact plans, pricing, and available features may vary by country or platform.

Free Trial. Some subscription plans may include a free trial period.

Unless cancelled before the trial expires, the Subscription automatically converts into a paid Subscription and the applicable subscription fee will be charged through your Apple App Store or Google Play account.

Free trials are generally limited to one per Apple ID or Google account unless otherwise specified.

Billing. Subscriptions are billed by Apple or Google through their respective app stores.

Payment is charged at confirmation of purchase.

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before renewal.

Renewal charges will be processed using the payment method associated with your App Store or Google Play account.

Cancellation. Subscriptions may be cancelled at any time through your device's subscription settings.

Cancellation becomes effective at the end of the current billing period.

You retain access to premium features until the Subscription expires.

Refunds. All subscription purchases are subject to the refund policies of Apple or Google.

Point.Piste does not process or approve refunds for subscriptions purchased through the Apple App Store or Google Play Store.
 

10. Bluetooth Connectivity and Wireless Buttons

Certain App features support wireless Bluetooth devices, including compatible Flic™ smart buttons.

Bluetooth functionality depends on factors outside our control, including:

• mobile device hardware;

• operating system version;

• Bluetooth performance;

• environmental interference;

• third-party software.

Connection quality may therefore vary between devices and environments.

The wireless button is a separate physical product and is not included with the App unless explicitly stated.

Use of Bluetooth features requires that you grant the necessary permissions on your device.

Point.Piste is not responsible for connectivity issues resulting from unsupported devices, operating system limitations, Bluetooth interference, or third-party hardware or software.

11. Intended Use

Point.Piste Products and Services are intended solely for sports scorekeeping, match management, training, coaching, and related recreational or professional sporting activities.

You agree to use the Products and Services only for their intended purpose and in accordance with any instructions provided by Point.Piste.

Our Products and Services must not be used in situations where malfunction could reasonably result in:

• personal injury;

• medical decisions;

• emergency response;

• life-support systems;

• public safety operations; or

• any other safety-critical application.

You are responsible for ensuring that the Products are suitable for your intended use.
 

12. Product Updates and Availability

We continually improve our Products and Services.

Accordingly, we may:

• update product specifications;

• modify App features;

• improve firmware or software;

• discontinue Products or Services;

• replace components with equivalent alternatives.

These changes are intended to improve quality, compatibility, reliability, or security and do not constitute a defect.

While we strive to maintain continuous availability of our Services, we do not guarantee that the Website or App will always be available without interruption.

Maintenance, software updates, server outages, internet connectivity, or third-party platform issues may temporarily affect availability.

13. Battery and Consumable Components

Products containing batteries are designed for normal consumer use.

Battery performance depends on many factors, including:

• frequency of use;

• charging habits;

• storage conditions;

• ambient temperature;

• age of the battery.

Normal battery ageing and gradual capacity reduction are expected characteristics and do not constitute manufacturing defects.

Unless otherwise stated by applicable law, batteries and other consumable components are not covered against normal wear resulting from ordinary use.
 

14. Returns

Consumer returns are governed by the Point.Piste Return Policy, which forms part of these Terms.

If you are a consumer residing in the European Union, you may have statutory rights that cannot be limited or excluded by these Terms.

Nothing in these Terms affects your mandatory consumer rights under applicable law.
 

15. Warranty

Physical Products are covered by the Point.Piste Warranty Policy.

The warranty applies only to manufacturing defects occurring during normal intended use.

The warranty does not cover damage resulting from:

• accidents;

• misuse or abuse;

• improper installation;

• unauthorized repair or modification;

• water damage where the Product is not rated for such exposure;

• excessive heat or environmental damage;

• cosmetic wear;

• normal wear and tear;

• use contrary to supplied instructions.

Warranty claims are handled in accordance with the Point.Piste Warranty Policy.
 

16. Intellectual Property

All intellectual property rights relating to Point.Piste Products and Services remain the exclusive property of Point.Piste or its licensors.

This includes, but is not limited to:

• trademarks;

• logos;

• product names;

• software;

• firmware;

• source code;

• graphics;

• photographs;

• videos;

• documentation;

• Website content;

• App content;

• product designs.

Nothing in these Terms transfers ownership of any intellectual property to you.

You may not reproduce, distribute, publish, modify, or commercially exploit any content without our prior written permission.

17. Privacy

Your personal data is processed in accordance with the Point.Piste Privacy Policy.

By using our Services, you acknowledge that certain information may be processed as necessary to:

• provide Products and Services;

• process orders;

• manage subscriptions;

• provide customer support;

• improve our Products;

• comply with legal obligations.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Point.Piste shall not be liable for:

• indirect, incidental, special, or consequential damages;

• loss of profits;

• loss of revenue;

• loss of business opportunities;

• loss of data;

• interruption of business;

• loss of goodwill;

• damages resulting from improper installation, misuse, neglect, or unauthorized modification of Products;

• Bluetooth connectivity issues beyond our reasonable control;

• incompatibility with third-party hardware or software;

• failures resulting from operating system updates;

• internet service interruptions;

• delays caused by third-party service providers.

The App and Website are provided on an "as is" and "as available" basis without warranties of uninterrupted operation or compatibility with every device.

To the maximum extent permitted by law, our total liability arising from any claim relating to the Products or Services shall not exceed the amount actually paid by you for the Product or Subscription giving rise to the claim.

Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.
 

19. Third-Party Services

Certain Services depend upon third-party platforms or technologies, including but not limited to:

• Apple App Store;

• Google Play Store;

• Bluetooth technology;

• payment service providers;

• shipping carriers.

Your use of these third-party services is subject to their own terms, privacy policies, and operating procedures.

Point.Piste is not responsible for the availability, policies, security, or performance of third-party services beyond our reasonable control.

20. Force Majeure

Point.Piste shall not be liable for any delay or failure to perform its obligations under these Terms where such delay or failure results from events beyond our reasonable control, including but not limited to:

• natural disasters;

• floods, fires, earthquakes, or severe weather;

• war, armed conflict, terrorism, or civil unrest;

• strikes, labour disputes, or industrial action;

• government actions, sanctions, or changes in legislation;

• customs inspections or border restrictions;

• transportation or supply chain disruptions;

• shortages of materials or components;

• failures of telecommunications, internet services, cloud infrastructure, or utilities;

• epidemics, pandemics, or public health emergencies.

Our obligations will be suspended for the duration of the force majeure event, and we will make reasonable efforts to resume performance as soon as practicable.
 

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable by a court or other competent authority, that provision shall be enforced to the maximum extent permitted by applicable law.

The remaining provisions of these Terms shall remain in full force and effect.
 

22. No Waiver

Failure or delay by Point.Piste to exercise or enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.

Any waiver shall be effective only if made expressly in writing.
 

23. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Products, Services, business operations, or applicable laws.

The latest version will always be published on our Website and will indicate the "Last updated" date.

For purchases of physical Products, the version of the Terms in effect at the time your order is accepted will apply to that purchase.

For continued use of the Website, App, or Subscription Services after updated Terms become effective, your continued use constitutes acceptance of the revised Terms.

If you do not agree with the updated Terms, you should discontinue using the affected Services.
 

24. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Finland, without regard to its conflict of law principles.

If you are a consumer residing within the European Union, you also benefit from any mandatory consumer protection rights applicable in your country of residence. Nothing in these Terms limits or excludes those statutory rights.

Any dispute arising out of or relating to these Terms, the Products, or the Services shall be submitted to the competent courts of Finland unless mandatory consumer protection legislation provides otherwise.
